These Terms of Service ("Terms") govern your access to and use of the website harbuilders.com (the "Site"), operated by Har Builders Reality (M) Sdn Bhd (SSM No. 202501032077 (1633489-A)), formerly known as Har Builders Enterprise (SSM No. NS0067634-H) (collectively "Har Builders", "we", "us" or "our"), a CIDB Grade G3 registered contractor (categories B – Building, CE – Civil Engineering, ME – Mechanical & Electrical) based in Seremban, Negeri Sembilan, Malaysia. The business was established as Har Builders Enterprise on 10 March 2010 and has since been upgraded to Har Builders Reality (M) Sdn Bhd.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

2. Acceptable Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. When using our contact form, you agree that you will:

  • Provide accurate, current, and truthful information;
  • Use the form only to make genuine enquiries related to our construction and renovation services;
  • Not submit any unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable content;
  • Not attempt to submit malicious code, spam, or automated bulk submissions;
  • Not attempt to gain unauthorised access to any part of the Site, our servers, or any systems connected to the Site.

We reserve the right to disregard, delete, or refuse to respond to any submission that violates these Terms.

3. Intellectual Property

All content displayed on the Site — including but not limited to project photographs, videos, case studies, and descriptions shown in our "Our Works" / Portfolio section, our logo, and the text, graphics, and layout of the Site — is the property of Har Builders Reality (M) Sdn Bhd, unless otherwise stated, and is protected by applicable copyright, trademark, and other intellectual property laws of Malaysia.

You may view and share content from the Site for personal, non-commercial reference (for example, sharing a link to a project page). You may not reproduce, republish, distribute, modify, or use our project photos, videos, or descriptions for commercial purposes, or represent them as your own work, without our prior written consent.

4. No Binding Quotation

The information on the Site, including service descriptions, project examples, and any indicative figures, is provided for general informational purposes only. It does not constitute a binding quotation, tender, or offer of contract. Any actual quotation, scope of work, pricing, and timeline for a construction or renovation project will only be provided in writing following a formal consultation and site assessment, and will be governed by a separate written agreement between Har Builders and the client.

5. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by Malaysian law, Har Builders makes no warranties or representations, express or implied, regarding the accuracy, completeness, reliability, or availability of the Site or its content, and disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components.

6. Limitation of Liability

To the fullest extent permitted by law, Har Builders shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from, or in connection with, your access to or use of, or inability to access or use, the Site, or your reliance on any information presented on the Site. This limitation applies regardless of the legal theory on which a claim is based and whether or not we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Malaysian law.

7. Third-Party Links and Social Media

The Site may contain links to third-party websites and to our official Instagram, Facebook, and TikTok accounts. We are not responsible for the content, accuracy, or practices of any linked third-party site or platform. Your use of any third-party site or social media platform is governed by that platform's own terms and policies.

8. Changes to the Site and These Terms

We may update, modify, or discontinue any part of the Site, and may revise these Terms, at any time without prior notice. The updated Terms will be posted on this page with a revised effective date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by, and construed in accordance with, the laws of Malaysia. Any dispute arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Malaysia.
